Dear Colleagues

Firstly I wish to thank all of you for your support and co-operation during this challenging period. In particular, I wish to thank all of those practitioners who managed to get their cases ready for hearing at short notice to ensure efficient use of valuable judicial time.

As you are aware, my motion lists, case progressions lists and callovers, have now resumed in the pre-Covid manner but with the social distancing measures in place (details of which are on www.courts.ie). The next callover and motion lists are on Monday 22nd June 2020 in Clonmel Courthouse.

The following measures continue to apply as we resume normal motion lists, callovers and case progressions

I just want to remind all practitioners that there is no need for the parties or their representatives to attend at my motion lists or case progression lists where the parties have agreed terms or have agreed to an adjournment. They must email the office in advance (copying the other party) advising of the agreed terms and I will make the appropriate Order.

In relation to callovers, the parties should email the office to advise of whether they are seeking a date or an adjournment, and if they are seeking a hearing date, then they should advise of the estimated duration of hearing and the total number of persons in attendance (including parties, witnesses, solicitors and barristers). Where such an email is sent to this office (before 10am on the morning of the scheduled callover), there is no need for either party to attend at the callover.

In relation to care representative appointment applications, again there is no need for practitioners to attend. They should submit the full application ensuring that all proofs are in order and I will make the appropriate order in the office.

Finally where parties have agreed (due to health concerns) that they would prefer a remote hearing, please email me directly to organise same.

I intend to conduct all taxations during this term via remote hearing so long as both parties agree to same. If either party objects to a remote hearing, then I will promptly schedule a hearing in the normal manner in Nenagh, Clonmel or Thurles as appropriate.
